Today the Guarantor for the protection of personal data has expressed a favorable opinion on the new regulation scheme on the public register of users who oppose the use of their personal data and their telephone number for sales or commercial promotions. After this step it will be necessary to wait for the Prime Minister’s decree which can only arrive after the go-ahead from the Guarantor and Agcom.

In any case, the text modifies and updates the functioning of the so-called Public Register of Oppositions (Rpo), to which consumers who no longer wish to receive promotional calls must register. The text accepts the observations expressed by the Privacy Guarantor in previous opinions and takes into account the rules contained in the “capacity decree”.

Thanks to the innovations introduced, consumers will soon be able to oppose the receipt not only of unwanted calls via operator, but also of those made with the use of automated systems, methods of contact that until now had escaped the limitations enshrined in the previous regulations. The registration to the Rpo will involve, among other things, the revocation of the previous consents expressed by consumers, so as to avoid the continuation of any abuses.

“We appreciate the fact that the indications of the Guarantor for the protection of personal data have been accepted in order to offer greater protection to consumers against unwanted calls, in particular automated ones – said the President of the Guarantor Pasquale Stanzione -. The regulatory change made with the “capacity decree” and this new implementing regulation, while ensuring ample space for competition and commercial initiative, offer protection to citizens against a phenomenon, such as that of wild telemarketing, which is particularly invasive and intolerable, especially for the most vulnerable “.

Consumer associations say they are skeptical. «Is the new telemarketing register really underway? – asks Massimiliano Dona, president of the National Consumers Union -. It would be time!
