From 1 September, the Green Pass obligation will affect 3.5 million workers. Between self-employed and employees, education and health – the only ones in
for which there is an obligation for the workforce – they absorb 1.6 and 1.9 million employees respectively. On the other hand, no prescription is inserted for those who work in long-distance transport (trains, ships, airplanes, buses): the legislation affects only passengers and not employees (almost 622 thousand).
Complexity and contradiction of the legislation on the Green Pass which, underlines Fondazione Studi Consulenti del Lavoro, was forcibly reflected in the debate on the mandatory vaccination in the workplace this summer and, consequently, on the document required to access some services and activities. In fact, even in the sectors where the Green Pass is mandatory for “insiders”, there is no lack of inconsistencies: for example, while school staff are required to be green certified and, in case of violation, the sanction provides for the suspension of the employment relationship without pay after the fifth day of absence due to lack of the Green Pass, for pupils, up to high school, there is no obligation. On the other hand, there are several cases of catering and transport, where the obligation imposed on customers does not correspond to any obligation for workers.
