For those who voluntarily join smart working there will be an obligation of 40% of the work in presence. The rest, 60%, can be done remotely. The right to disconnect and respect for working hours for work performance are introduced. Furthermore, the fiduciary relationship makes the stamping of the card for work in attendance disappear. This is what the new agreement signed by Michelin Italia (Sami Italia) and Filctem Cgil, Femca Cisl, Uiltec Uil provides to regulate agile work.
After the national protocol reached at the Ministry of Labor by the social partners, the unions and the company have found their own declination which will now be brought to the workers’ assemblies for the definitive go-ahead. The goal, explain the trade unions, “is to obtain the best possible balance between private and professional life, confirming the principle that sociality in the workplace continues to be indispensable, both for workers and for the company, for the achievement of objectives of performance, progress and necessary evolution and permanent professional growth of the workers ».

In detail, the agreement reached provides that the worker who voluntarily joins remote work will have the constraint of 40% of the performance of his activity in presence. Stamping for work performed in presence will be eliminated, as an effect of the fiduciary and responsibility nature of the new working method which will allow individual hours of extraordinary work to be entered.

The agreement also governs the right to disconnect, while the performance of the service remotely must take place within 8 hours of daily work. In the hypothesis of agreement, in fact, the bands of work performance even if not continuous with respect to the traditional hours applied for the activity in presence, the restriction of the canteen and physiological breaks, the definition between team and worker also of the workloads and mandatory moments of socializing, withdrawal and termination times, the commitment to facilitate access for workers in conditions of fragility and disability.
