Motorway concessions, Italy still violates European rules and Brussels finally starts the infringement procedure. Once again. A years old story, which reopens. In the sights of the European Commission the authorization to manage the A12 Livorno-Civitavecchia motorway was over. There was a fear that the renewal had occurred in violation of the public procurement directive, and already in September 2019 the EU Court of Justice ruled that Italy has done wrong, extending the duration of the motorway concession to the Autostrada Company Tirrenica (SAT) without first launching a tender procedure.

After two years nothing has changed. “It seems that Italy has not yet adopted the measures to ensure the timely execution of the sentence”, complains the EU executive. Hence the decision to initiate infringement proceedings. Italy now has two months to convince the Commission not to proceed further. Another sentence this time would mean hefty fines. In this case, Italy will not have a second warning. Either the story ends or he will find himself once again at the stand.

The affair involves ANAS. It is the motorway management company that modified the 1999 agreement with SAT, which granted Società Autostrada Tirrenica to take charge of the A12 until 31 October 2028. In 2009, however, the two parties signed a single agreement that extended up to at 31 December 2046 the concession of the motorway section to SAT. The violation of the European rules has been consummated here. It was not necessary to proceed with the agreement but to launch a tender.
