Ubi investigation, acquitted Bazoli and the former leaders of the popular

The Bergamo court, chaired by judge Stefano Storto, acquitted the banker Giovanni Bazoli, former president of Intesa Sanpaolo, in the Ubi Banca trial, relating to alleged irregularities in the management of the credit institution. Bazoli was acquitted for the crime of obstructing the supervisory authority “because the fact does not exist” and for the crime of illicit influence in the shareholders’ meeting “for not having committed the fact”, in relation to the Ubi Banca assembly on 20 April 2013.

The latter offense for the Bergamo prosecutor Paolo Mandurino, owner of the file, was barred in June of this year. At the end of the indictment, the prosecutor had asked for a sentence of 6 years and 8 months of imprisonment for Bazoli, then adding in the repetition phase the request for a reduction of the sentence of 6 months by virtue of the prescription of the crime of illicit influence in the assembly. The court, on the other hand, acquitted Bazoli on the merits.

The former leaders also acquitted. The former managing director Victor Massiah was acquitted of the accusation of obstruction to the supervisory authority because “the fact does not exist” and was acquitted of the charge of illicit influence in the shareholders’ meeting due to a statute of limitations, the former chairman of the board of Supervision Andrea Moltrasio and the former Chairman of the Management Board Emilio Zanetti were acquitted on the merits of both charges, “because the fact does not exist” from the crime of hindering the supervisory authority and “for not having committed the fact” by supervisory offense and unlawful influence in the shareholders’ meeting, in relation to the Ubi Banca assembly held on 20 April 2013. The prosecutor of Bergamo had asked Massiah to be sentenced to 5 years of imprisonment, for Moltrasio to 5 years and 10 months and for Zanetti to 5 years and 10 months with a fine of 10 thousand euros. In light of the prescription of the crime of unlawful influence in the assembly, during the replies, the prosecutor had asked for a reduction of 6 months in the requests for sentencing already advanced. The court acquitted the defendants. The reasons will be filed within 90 days.
