ROMA – The awaited clarification on the correct use of the “test plate” on vehicles, registered and not, has finally arrived. An important news for the thousands of operators in the sector who feared obstacles and sanctions for their activities and that what specified in the Infrastructure decree approved by the Council of Ministers has definitively clarified. In detail, the decree-law specifies that “The authorization for the circulation of evidence referred to in article 1 of the decree of the President of the Republic no. 474, can be used for road circulation of non-registered vehicles and those already in possession of the registration certificate referred to in articles 93, 110 and 114 or the movement certificate referred to in article 97, also in derogation of the obligations established from Article 80 of Legislative Decree 285 of 30 April 1992, if said vehicles circulate on the road for needs related to technical, experimental or construction tests, demonstrations or transfers, also for reasons of sale or set-up. For the purposes of the circulation referred to in the first period, the obligation of insurance coverage by the holder of the authorization to test circulation remains unaffected, pursuant to the current provisions on civil liability towards third parties “.
The decree also contains a further clarification aimed at regulating the number of test plates available to operators to avoid their illegitimate use. “By decree of the President of the Republic, adopted pursuant to article 17, paragraph 2, of law no. 400, within ninety days from the date of entry into force of the law converting this decree, the decree of the President of the Republic no. 474, also in order to establish the conditions and the maximum number of test circulation authorizations that can be issued to each holder based on the type of activity carried out and the number of employees. “” Our battle – declared the president of Confartigianato Autoriparazione, Alessandro Angelone – has led to a result that we have been chasing for years and that puts an end to a dispute that has involved politics (ministries of the Interior and Infrastructures), justice (courts and Court of Cassation) and police forces, causing many problems to car repairers.
