Two Hs against two Cs, both crossed: for the Court of the European Union, the logo of the Huawei tech brand cannot be traced back to that of the Chanel fashion house. This concludes the lawsuit brought by the French company against the Chinese group in 2017, which had as its object a logo deemed too similar, consisting of two crossed Hs.

In 2019, the European Union Intellectual Property Office had rejected Chanel’s application, judging that there was no risk of confusion in the public between the two logos, being that of the double C immediately recognizable and associated with Chanel. Chanel then appealed against this decision, to ask for it to be annulled, but the Court of the European Union rejected the appeal, noting that the trademark requested by Huawei is “a figurative sign composed of a circle containing two curves that resemble the ‘image of two black letters’ u’ arranged vertically and opposite each other, which cross and intersect to form a central element which constitutes a horizontal ellipse. As for the two Chanel brands, they are composed of two curves that resemble the image of two letters “c”, black in color, arranged horizontally and opposite each other, which cross and intersect to form a vertical ellipse, where the second has the peculiarity of containing said curves in a circle “, reads the note released by the Court itself. Which recognizes that «the conflicting marks have certain similarities», but underlines how «their visual differences are relevant. As regards the Chanel brands, in particular, the curves are more rounded, their outlines are thicker and their arrangement is horizontal, while that of the Huawei brand is vertical “.
