Creative Commons appeal: “Let’s free works of public goods from copyright”

Creative Commons Italian Chapter launches an appeal to the governments of the European Member States and to cultural institutes (museums, archives, libraries, galleries and archaeological sites) to ensure the best implementation of art. 14 of Directive EU / 2019/790 on copyright in the digital single market. The law represents an important opportunity to act in this direction, removing the related rights on images reproducing works of visual arts in the public domain if “the act resulting from the reproduction is not in itself an original work”.

The appeal aims to promote the free circulation, for any purpose, of images of public cultural assets no longer protected by copyright, giving concrete implementation to two fundamental principles: “cultural heritage in the public domain belongs to everyone “And” culture can be a driving force for economic development “.

The appeal was signed by most of the European chapters of Creative Commons and by important associations representing the cultural sector at national and international level, as well as by associations representing the rights of civil society (AIB, AISA, ANA, ANAI, ArcheoFoss, CIA , Federculture, ICOM Italia, Wikimedia Italia, Communia, Free Knowledge Advocacy Group EU-Wikimedia, ICA, etc.).

The Coronavirus emergency has greatly contributed to the rediscovery of the centrality of the web and of digital in communicating cultural heritage to the public by stimulating initiatives worldwide to offer free reuse, including for commercial purposes, of digital resources on the net to overcome physical distances. imposed by the contagion containment measures: these are experiences that will be essential to treasure, even and above all after the end of the emergency, to relaunch cultural entrepreneurship, the creative industry, tourism, as well as study and scientific research.

In light of these premises, this appeal is addressed to the Member States to implement the principle enucleated by Article 14 in the widest and most harmonized way possible, favoring the general adoption by cultural institutions of legal tools to identify content in the public domain and , when appropriate, open licenses, for the free reuse, for any purpose, of the images of the heritage.

By 7 June 2021, European Member States will have to transpose the European Copyright Directive (EU Directive 2019/790 of the European Parliament and of the Council of 17 April 2019 on copyright and related rights in the digital single market); Creative Commons therefore hopes that this provision will be implemented in the widest possible sense, that is, which draws inspiration from the guidelines disseminated by Communia: it would also represent the best way to fully pursue its institutional aims of promotion, conservation and dissemination of cultural heritage.
