Doctors who work for the National Health Service will be able to remain in work until they are 72 years of age: the choice will be on a voluntary basis, but the white coat will be able to remain in the ward until 31 December 2025 at the latest. But with one fundamental condition: who decides to postpone retirement, he will not be able to maintain or take on top management positions (essentially being a head doctor). Those who retired from 1 September 2023 will also be able to return to service. This is a summary of the measure approved under the milleproroghe decree. But let’s look in more detail at the new rule that extends the retirement age of health workers.

The audience of doctors to whom the measure is aimed

As mentioned, the law provides for the possibility for “national health service companies, until 31 December 2025″ to be able to “retain in service, at the request of interested parties, medical and healthcare managers employed by the national health service”. Today they can remain at most until they are 70 years of age but always with the authorization of the ASL. Their use will be useful “also” to meet “the training and tutoring needs of staff”: in practice, senior doctors will be able to help younger ones. But obviously they will be able to return to providing assistance to “deal with the serious shortage of staff” in the wards. The rule concerns not only the white coats who work in the local health authorities, but also the medical and healthcare managers of the Ministry of Health («in article 17, paragraph 1, of law 11 January 2018, n. 3») and above all the «teachers university students who carry out healthcare activities in medicine and surgery”.

The conditions for being able to postpone the pension and “recallables”

Among the main constraints is the fact that anyone who decides to postpone retirement will not be able to maintain or take on top management positions “of a complex or departmental or general level structure”, in short, those who are head doctors will have to renounce the role. That’s not all because the measure also allows those who have already retired to be “recalled” always “until they reach seventy-second years of age and in any case no later than 31 December 2025”: in particular, these are staff “who have been retired from from 1 September 2023 having fulfilled the age and contribution requirements for old-age retirement”. Those who return to service will, however, have to opt “for maintaining the social security treatment already in use or for the payment of the remuneration connected to the role to be assigned”. This is a point that needs to be clearly clarified and which will most likely require an explanatory circular from the Ministries of Health and Labour.
