The Court of Appeal of Brescia admitted the appeal of Olindo Romano and Rosa Bazzi, sentenced to life imprisonment for the Erba massacre, setting the hearing for March 1st at the end of which the judges will decide on the review request presented by the defenses of the two spouses and by the deputy prosecutor of Milan.

The Court cited the civil parties and also the Attorney General of Milan, in the person of the deputy prosecutor Cuno Tarfusser. The judges will evaluate, at the end of the discussion between the parties, whether to reject the requests or accept the new evidence proposed by the lawyers Fabio Schembri and Nico D’Ascolo for Olindo Romano and Luisa Bordeaux and Patrizia Morello for Rosa Bazzi and order the review of the trial .

In the massacre of 11 December 2006, Raffaella Castagna, her son Youssef, just over two years old, Raffaella’s mother, Paola Galli and one of their neighbors, Valeria Cherubini, were killed. Only Cherubini’s husband, Mario Frigerio, who died a few years later and was a key witness in the trial, recognizing Olindo Romano as her attacker, was saved, although seriously injured.

Olindo Romano and Rosa Bazzi confessed to the massacre and then recanted but were definitively sentenced to life imprisonment.

The legal Romano spouses, ‘Now the game is reopened’

For Fabio Schembri, who with his colleague Nico D’Ascola defends Olindo Romano, “it is a great satisfaction to have reopened the game” on the fate of Olindo and
of his wife Rosa Bazzi sentenced to life imprisonment for the Erba massacre on 11 December 2006.

This is how he commented on the decision of the Court of Appeal of Brescia to discuss the request for review of the sentence for the former garbage collector and his wife (defended by the lawyers Luisa Bordeaux and Patrizia Morello). “Our real satisfaction, however – added the lawyer – is whether an acquittal will arrive, requested on the basis of the new evidence”.

The defense is counting on new witnesses and consultations

There are some new witnesses and a substantial series of consultations at the basis of the request for review of the sentence which definitively condemned Olindo Romano and Rosa Bazzi for the Erba massacre (four dead and one seriously injured on 11 December 2006).

One of these, “never heard at the time” according to the couple’s defenders, is a man who lived in the house of the massacre, linked to Azouz Marzouk, husband of Raffaella Campagna, one of the four victims. The man had reported a feud with a rival group, in which he was also injured with a cutting weapon and had claimed that the house of the massacre “was the base of the drug dealing which was carried out in the nearby market square and the place where the proceeds were deposited”. Another witness cited by the defense is “a former policeman who reports on the investigations and the missing parts of 50% of the key moments of the wiretaps”.

The consultancies support the incompatibility of the reconstruction made by the spouses – and then retracted – of the massacre with that which emerged from the investigations. An essay concerns the testimony of Mario Frigerio, the only survivor of the massacre, who died in the following years, and became the main witness for the prosecution who recognized Olindo in the courtroom. A version at trial which, for the lawyers, would contrast with what Frigerio declared immediately, in the hospital bed.

Even the reconstruction in the sentences of the death of Frigerio’s wife, Valeria Cherubini, would contrast with those that emerged
from their consultancy.

Castagna, they will find no other truth about the massacre

Giuseppe Castagna, who lost his mother, sister and nephew in the Erba massacre, is not shaken by the decision of the judges of Brescia to discuss the request for review of the sentence for Olindo Romano and Rosa Bazzi.

“They can search all sorts of ways, but they will never find another truth,” he says. “Every time we received news of defense or media initiatives we felt pain, now it’s almost boredom: we were even personally attacked”, she adds.
