Pending the ruling of the Constitutional Court, which has prolonged the discussion on the constitutional legitimacy of the life imprisonment, the big drum has started in the media of those who try to influence the judges by fearing the risk of giving in to organized crime. Indeed, a real favor to the mafia. Fortunately we are not in the presence, or at least no one is aware, of threats against the supreme judges, otherwise we would already be in the “negotiation” area. But one of the arguments most used by the supporters of life imprisonment is the one expressed by Gian Carlo Caselli in Corriere della Sera: who said that Italy must respect the European Convention on Human Rights? “The prediction is based on the fact that the European Court of Human Rights has already demolished the life imprisonment with a 2019 sentence – writes Caselli -. But are we sure that the supreme instance of the Italian jurisdiction must, always and in any case, pay unconditional and slavish obedience to European justice? ”.
