Decision background

To make a decision, the Court recalled that “the concept of forced displacement due to environmental factors and highlighted that this can be caused by both environmental disasters “both sudden and gradual processes of environmental deterioration, such as climate change, deforestation or ocean acidification”.

He also said that “the State has a series of obligations before, during and after displacement due to environmental factors,” such as creating an administrative registration system to recognize this type of victims and make them an institutional offer to address their situation.

For this reason, “the population displaced by this phenomenon must receive urgent and prioritized attention, since it is a phenomenon that already significantly impacts the Colombian population, especially those in the greatest condition of vulnerability.”
