Twist in the Supreme Court after the words of the prosecutor who asked for the postponement on appeal to consider the slight extent of the corruption system

With yet another twist, the Supreme Court confirms the sentences of the two nurses and puts an end to the corruption affair in the mortuaries of Ivrea and Cuorgnè, known as the “dearly departed”. The attorney general, in fact, had asked to postpone the positions of Gian Piero De Filippi, 54, from Busano, defended by the lawyer Paolo Maisto, and Gianni Biolatti, 45, from San Giusto Canavese, represented by the lawyer Massimo Strumia, in the Court of Appeal, to consider a possible acquittal for the slight extent of the corruptive conduct. But the stoats rejected the appeal. “The words of the pg are a small consolation – explains Maisto -, but that leaves more than a few thoughts”.

We return, in fact, to the appeal sentence, which had already partially reduced the story. De Filippi had been sentenced to one year (while two were imposed in the first instance) and Biolatti to one year and 4 months (reduced sentence compared to the 28 months imposed by the court of Ivrea). Mauro Colmuto, 61, and Daniela Capelli, 55, both resident in Cascinette and defended by the lawyer Pio Coda have instead pledged on appeal, respectively, one year and two months and nine months of sentence. The court of Ivrea had imposed sentences of two years and five months and two years and two months. The appeal sentence, in fact, reduced the impact of the affair, granting all defendants a suspended sentence, but still recognized the existence of corruption crimes, due to the system of “tips” set up in the chambers mortuary, and fraud, for having, Biolatti and Capelli, simulated the presence of Colmuto at work by passing the badge while he was absent.

All acquitted, however, the owners of funeral homes. But in some cases the fact was recognized and the acquittal took place because of “particular tenuousness”. This latter case was applied in the cases of Giovanni and Paola Allera, Pietro Florian, Mauro Ceregati, Marco Regis, Giuseppe Sanapo, Stefano Spinucci and Claudio Brunetto. Here it was taken into account that the defendants were cleansed and that theirs was not a habitual conduct. Acquittal for not having committed the crime, however, for Lauretta Schiumski, Roberto Giglio Tos and Giuseppe Pavese.

The ASL / To4, the civil party in the affair through the lawyer Andrea Castelnuovo, was recognized as a 15 thousand euro provisional, in addition to the payment of legal fees. «Professionally – explains the lawyer Andrea Castelnuovo -, I express great satisfaction because the Attorney General of the Court, at the hearing, surprised me by asking for the annulment of the sentence. So much satisfaction for having managed to convince the Supreme Court of our reasons and of the correctness of the work of the court of Ivrea and of the Turin court of appeal in sanctioning such incorrect behavior “.
