Original Title: Details Disclosure of Biological Father’s Crime in the Case of Two Children Falling to Death in Chongqing
On July 26, the Fifth Intermediate People’s Court of Chongqing Municipality formed a seven-person collegiate panel in accordance with the law. The first instance opened a public hearing to hear the case of defendants Zhang Bo and Ye Chengchen intentional murder and the plaintiff Chen Moumou in an incidental civil lawsuit.
The public prosecution agency charged that Zhang Bo and Chen Moumou gave birth to daughter Zhang Mojia (victim, 2 years old) and son Zhang Moyi (victim, 1 year old) after they got married in August 2017. Around April 2019, Zhang Bo filed a divorce with Chen Moumou while concealing the fact that he was married and had children to pursue netizen Ye Chengchen. Around August of the same year, Zhang Bo and Ye Chengchen established a private relationship. After Ye Chengchen learned that Zhang Bo had a child, he continued to associate with Zhang Bo.
In February 2020, Zhang Bo and Chen XX agreed to divorce. The two parties agreed that Zhang XX would be brought up by Chen XX, and Zhang XX would be raised by Zhang Bo before the age of six, and Chen XX would be raised after the age of six. Ye Chengchen told Zhang Bo that he and his parents could not accept that Zhang Bo had a child. The two conspired and agreed to kill Zhang Jia and Zhang B by accidentally falling.
In June of the same year, Ye Chengchen repeatedly urged Zhang Bo to commit crimes through WeChat. In October of the same year, Zhang Bo and Ye Chengchen agreed to take Zhang Mojia to Zhang Bo’s home to commit the crime on the grounds of buying clothes for Zhang Mojia. On October 25, Zhang Bo asked his mother to contact Chen XX to take Zhang XX from his rented home in a community in Nan’an District, and later failed to commit the crime because Chen XX was always present.
On November 1st of the same year, Zhang Bo once again asked Chen to take Zhang Jia to his home and stay overnight. At about 15:30 in the afternoon of the next day, Zhang Bo, taking advantage of no one else in the house, threw Zhang A and Zhang B who were playing in the second bedroom from the bay window of the second bedroom to the downstairs, causing Zhang to die on the spot. B died after being sent to the hospital.
The public prosecution agency believes that the defendants Zhang Bo and Ye Chengchen intentionally murdered and caused the death of both of them, and they should be held criminally responsible for the crime of intentional homicide in accordance with the law.
The plaintiff in the incidental civil lawsuit, Chen Moumou, asked the two defendants to compensate for economic losses such as funeral expenses, lost work expenses, and transportation expenses, and bear joint and several liability for compensation.
During the trial, the court conducted a court investigation on the criminal facts and evidence charged by the public prosecution agency, as well as the plaintiff’s litigation request in an attached civil lawsuit. During the court debate, both the prosecution and defense, the plaintiff in the incidental civil lawsuit, and the agent ad litem fully expressed their opinions. After the court debate, the defendants Zhang Bo, Ye Chengchen and the plaintiff Chen XX in the incidental civil lawsuit made final statements. In the final statement stage, the plaintiff of the incidental civil lawsuit Chen Moumou said in court that he withdrew the incidental civil lawsuit and demanded severe punishment for the two defendants. The courts are equal and fully protect the litigation rights of all litigation participants. The defendant’s relatives, the victim’s relatives, NPC deputies, CPPCC members, journalists and the masses attended the trial.
In the end, the court announced an adjournment and an optional sentence was announced.
