The Senate classroom gives the definitive go-ahead to the decree on urgent measures in the field of justice and defense, extensions on the subject of referendum, temporary allowance and IRAP, already approved last week by the Chamber, on which the government has placed its trust . The votes in favor are 210, those against 30 and no abstentions. The vote is also valid as a final vote on the provision
The decree is a sort of mini-omnibus, that is, with measures of various kinds. The first article, on the subject of justice, intervenes on the Code for the protection of personal data and limits access to telephone and electronic traffic data (the records) in criminal investigations, allowing it only for serious or specific crimes and always requesting authorization. or the validation of the judge at the request of the prosecutor. Furthermore, the traffic data may be relevant for ascertaining the facts and no longer for the continuation of the investigations.
The Chamber has also introduced a rule on computer detectors, the so-called “trojans”, that is capable of entering the memories of computers and smartphones and capturing their contents: the use of the computer detector can be authorized by the judge if the reasons that make this method is necessary for carrying out the investigations are “specific”.
Less problematic is the second article which broadens the criteria for the assignment of the position of Chief of Defense Staff. The third article extends the deadline for submitting the signatures of the cannabis referendum from 30 September to 31 October, after this deadline was extended in July for the other referendums (euthanasia and justice).
Another extension from 30 September to 31 October 2021 concerns the deadline within which to apply for a temporary allowance for minor children, for the purpose of recognizing the arrears of monthly payments. The decree then postpones the deadline for the payment, without penalties and interest, of the unpaid and suspended IRAP from 30 September to 30 November on the basis of the 2020 Relaunch decree.
