Fine canceled for the foreign license plate: the Belluno ice cream makers win their battle

by admin

The justice of the peace cancels the sanction against a Belluno ice cream maker. “Now this sentence can be challenged by everyone”

The reactions

It is not the first sentence that recognizes the free circulation in Italy of a motorist with a foreign car license plate. It is the fourth.

«It is the first», note the leaders of Uniteis, «which can concern all our ice cream makers».

So far, around twenty fines have been issued in the province. The fine ranges from 712 euros to 2 thousand. The lowest “content” has always been applied. In each case, the car was confiscated until regularization: Italian or German license plate. Six months to provide.

In one case, the car was sold at auction. Or rather, it was sent for sale, but since it had just come from an accident it was taken to the junkyard and the bill was charged to the person concerned.

«Uniteis did well to take legal action, in this case by the justice of the peace. And the Fiera di Longarone did well to strongly support this initiative ”, comments Roberto Padrin, mayor of Longarone and president of the Province. “A fundamental right is at stake here, namely that of free movement, in this case in Europe. A right that is authoritatively recognized “.

The theme concerns more than 5,000 ice cream makers working in Europe. But not only them, also the other Italian emigrants. For example, those who work in Switzerland risk a lot. The story originated with the Safety Decree which in 2018 modified the highway code by introducing the rule that those who reside in Italy cannot have a car with a foreign license plate. Otherwise, the car is seized, and if certain practices are not carried out, there is confiscation. Fate, that of the kidnapping, which already happened to a motorist from Valle di Cadore, coincidentally an ice cream maker.

“Beyond the new norm”, the mayor of Val di Zoldo, Camillo De Pellegrin, explained at the time, “the problem is that these workers do not have the characteristics to be registered in Aire, the registry that concerns Italians residing in the ‘abroad. The fact is that they have not moved permanently, but spend eight, nine months in Germany or elsewhere in Europe, and the rest of the year in Italy for the well-deserved vacation. According to the law, to be enrolled in this list one must spend at least 12 consecutive months abroad, something that does not happen in most cases to the people of Belluno ». –
