New driver accused of the crime of road injury. The injured party was rejected by the justice of the peace against the sanction of the brigade
PEDAVENA. First investigated, then accused without his knowledge. A new driver from Pedavena is on trial for road injuries. On March 16, 2017, the woman hit a lady who was walking in the same direction of travel; in the impact she fell to the ground, suffering a head trauma and some fractures for a prognosis of more than 40 days. The same victim had been fined, because she would not have paid the necessary attention, as she was about to cross the street from right to left.
The report was challenged before the justice of the peace, who however confirmed the sanction, giving reason to the Municipality of Pedavena, whose local police had carried out the legal findings. “The sanction was correctly imposed, even if, as regards the reconstruction of the accident, the applicant’s behavior will have to be examined, according to appropriate investigation methods, elsewhere”, wrote the honorary magistrate in the motivation.
The driver learned that he was being investigated for road injuries two years after the accident, which seemed conditioned at least by a conspiracy of guilt and had to equip himself with the lawyer Resenterra. The power of attorney accuses the motorist of negligence, imprudence and inexperience for not having adjusted the speed of the vehicle, paying attention to the particular circumstances of time and place (open road, near the town), in order to avoid any danger to safety of people and things.
