He wins 57 thousand euros in the Lotto but collects the citizenship income anyway: acquitted

Twice, between 2019 and 2020, she has been kissed by luck: two bets in the lottery, hitting winning combinations that have earned her a total of over 57 thousand euros regularly collected through the system of the Customs and monopolies agency, which trace the winnings exceeding 10 thousand euros.

But the law is clear: l” failure to communicate changes in income or assets, even if deriving from irregular activities or gambling winnings, is suitable for the revocation or reduction of citizenship income. This is what emerged from the sentence of 24 September 2021 – 15 February 2022, number 5309 of the Third Criminal Section of the Court of Cassation.

Despite the sudden increase in her assets, the lady, however, a 54-year-old from Verbania presented the DSU twice (at the beginning of 2020 and, twelve months later), the documentation certifying her economic situation for it to be disbursed – as it happened then – the citizenship income. A subsidy to which she was not entitled, however. To find out was the Guardia di Finanza, which investigated the report left by the Customs and forwarded the file to the Public Prosecutor’s Office.

Tried in court in Verbania for this affair, the woman was acquitted for lack of evidence, because the awareness of having presented untruthful DSU did not emerge clearly, and because it was not even ascertained whether the sums of the social benefit had been spent from her, since the card on which the citizenship income was credited was also in the availability of her partner.
