Of the sixteen suspects, eight have already reached an agreement. The others offer 20 thousand euros, the woman asks for 60 thousand
FELT. It is increasingly likely that an agreement will be reached in the lawsuit brought by a woman from Feltre, a victim of revenge porn, against the men who had spread a private intimate image of her. Yesterday there was the preliminary hearing, during which eight men came out of the proceedings, including the ex (accused of aggravated defamation, because at the time there was not yet the crime of revenge porn), after reaching a Compensation agreement with the injured party, who yesterday filed a civil action assisted by the lawyers Antonio Prade and Massimo Montino.
For the other eight, defended by lawyers Roberta Resenterra, Liuba D’Agostini, Giovanni Pelosio, Ferdinando Coppa, Enrico Tiziani, Nicoletta Zannin and Silvia Dolif, the decision will come in the next hearing on 25 June.
Yesterday the plaintiff asked for compensation for material and moral damages of 60 thousand euros to the eight suspects who remained in the proceedings. In turn, the defenses have offered, Banco Judicis, a total sum of 20 thousand euros. The public prosecutor Katjuscia D’Orlando (in place of the owner of the file Simone Marcon) considered the compensation proposal of the defenses to be adequate, defining it as satisfactory, in consideration of the alleged crime and the economic capacity of the suspects.
The word now passes to the judge, Enrica Marson, who in the next hearing will have to say whether or not he considers the offer appropriate. In the first case, the proceedings will close with a sentence of no place to proceed, as for the other eight suspects against whom the complaint has already been withdrawn.
If, on the other hand, the judge does not consider the offer congruous, in the next preliminary hearing it will be decided for the possible indictment of the suspects and the opening of the trial.
The facts date back to the period between 2019 and spring 2020. The first to spread the intimate photo of the woman was her ex, who had turned the image to a friend. At that point, the thing degenerated, with the relaunch of the photo in several chats, also accompanied by unpleasant and infamous comments.
A friend of hers had warned the woman that she had received the image and, during the investigation, it emerged how much it had become in the public domain, damaging the honor of the woman, who works in contact with the public and is therefore easily identifiable. .
The sixteen suspects are all residents between Feltre and Valbelluna and many of them must have been convinced that exchanging private photos of a woman was just a joker. This is also demonstrated by the name of the incriminated chats: “ZT Cagate Official”, “Bona la barista”, “Vignui Hot”, “Squirting Club 2019” and even “La Mala del Brenta”.
With the crime of revenge porn, in force since 9 August 2019, with the title of “Red Code”, we wanted to put a stop to acts that create damage, often irreversible, to the reputation and sexual honor of a woman. Revenge porn is a serious offense, with a sentence of up to six years in prison.
