In the ten dense pages of the order, deposited in the early afternoon, the investigating judge of Varese Giuseppe Battarino validated the arrest and ordered the precautionary custody in prison for Davide Paitoni, the 40-year-old accused of having stabbed his 7-year-old son to death and of the attempted aggravated murder of his wife. The man, defended by the lawyer Stefano Bruno, made use of the right not to answer during the validation hearing. The prosecutor proceeds for multiple homicide and for the attempted aggravated murder of the woman, legal qualification accepted by the judge. The public prosecution proceeds against Paitoni also for evasion – he was under house arrest for the attempted murder of a work colleague -, for resistance to a public official – for having rammed the carabinieri car who wanted to block the escape – and abusive port of a knife.
In the order, from what emerges, very harsh tones are used towards the man who must answer for the aggravating circumstance of abject reasons: by definition the vile, despicable reason is abject, which detects in the agent such a degree of perversity as to arouse a sense of repugnance in the person of average morality. Not only that: according to what beraking latest news learns, the ten pages also contain references to the marital situation and to the fact that there was no judicial measure on the separation. The agreement between the parties would therefore have allowed the child to see his father freely and during the Christmas holidays almost every other day.
If the prosecutor writes – in an official statement – of complaints filed “between March and last April” by his wife and father-in-law for “aggressive behavior against them” in the context “of the family conflict resulting from the wife’s decision to separate”, the prosecutor’s office he would not have made any requests against the man, therefore those disputes (for crimes that do not include the Red Code) would not have been part of the “evaluation material” on which the investigating judge ordered the house arrest order. This is a question that is not completely clear and that has been triggering controversy for days in public opinion but also within the Varese court itself.
Murder Varese, the minister Cartabia asks for urgent investigations on the death of little Daniele
On the crime of little Daniele, the Minister of Justice, Marta Cartabia, asked the inspectorate to “urgently carry out the necessary preliminary investigations” on the case. “Faced with this tragedy, this shocking, unthinkable, unjustifiable gesture, we can only express our closeness to little Daniele’s mother and commit ourselves even more against violence”. The Varese Public Prosecutor’s Office writes this in a note from the prosecutor Daniela Borgonova. “On November 26, in the course of a dispute that degenerated into a scuffle, Paitoni drew a knife and hit his colleague. After being arrested in flagrant by the judicial police, the prosecutor described the fact as attempted murder and asked , together with the validation of the arrest, the application of the precautionary measure of house arrest, on the assumption of the suspected social dangerousness, also for previous reports “. continues the note of the prosecutor Daniela Borgonova. “My son is safe, his parents must be careful”: these are the threatening words spoken by Davide Paitoni just before meeting the work colleague with whom he had a quarrel and then attacked with a cutter, being arrested for attempted murder. This is what emerges from the precautionary custody order signed by the investigating magistrate Anna Giorgietti on November 29, against the forty-year-old who killed his 7-year-old son Daniele on New Year’s Eve and tried to kill his wife.
Also in the document, the investigating judge motivates the precautionary needs at home, stating that “unsolved issues require an adequately protected investigation” and that therefore “the absence of limitations on Paitoni’s personal freedom and his communication skills would inevitably frustrate the course of investigations “. Then the order continues: “the Public Prosecutor highlights that Davide Paitoni would be subjected to other proceedings for crimes also characterized by violence (mistreatment and injuries), these are pending charges that could be resolved favorably for the suspect and which, therefore, do not they allow us to draw elements of any certainty “. The investigating judge then concluded with the decision to subject Paitoni to house arrest with the prohibition of communicating with the outside world, except with the elderly father. On 6 December the same investigating judge then accepted the suspect’s request to be able to see his son.
The funeral of the child will take place next Friday, January 7: the ceremony will be held at 2.30 pm in the oratory of San Luigi Schianno, which the child attended and where the animators after the tragedy remembered him with a moved post on Facebook. The mayor of Morazzone, Maurizio Mazzucchelli, announced it on social media adding that on the occasion “city mourning will be proclaimed in both Morazzone and Gazzada Schianno”, that is the two towns of Varese where Davide Paitoni and his wife lived respectively. returned with the child to live with their parents.
