The decision of the Court of Appeal which overturned the first degree sentence which had inflicted heavy sentences

15 bosses, followers and extortionists of the Brancaccio mafia district are back free. The Court of Appeal of Palermo declared the nullity of the decree that had ordered the trial, a decision that led to the cancellation of the trial which in the first instance had ended with very heavy sentences for the defendants. The judges ordered the release of all by limiting the restrictive measures to the sole obligation to sign. The proceeding stems from a 2017 investigation by the Palermo DDA that cleared the Brancaccio district. According to the lawyers of some defendants, the judge who ordered the indictment should have abstained because he had signed the extensions of the wiretapping. Despite the exceptions of the defenders, the first trial was held. Now the appeal with the decision on nullity. Among the defendants convicted and released from prison were the bosses Giovanni Lucchese and Giuseppe Caserta who in the first degree were sentenced to 17 and 18 years in prison respectively.
