UDINE. The Simplifications decree, containing the governance of the Recovery plan, enters the Council of Ministers on Friday 28 May.
These are the two pillars which, together with the recruitment plan for public administration technicians, scheduled for next week, will make it possible to ground the projects of the National Recovery and Resilience Plan.
Mario Draghi wants to accelerate and clearly says this to the ministers gathered in the control room at Palazzo Chigi in the morning, because “the agreement with the European Commission is to approve the two decrees by the end of May, so as to be able to access the first tranche as soon as possible of the funds, which will be spent by 2026. And for this to happen, in Italy, there is a lot to change ».
Ministers Andrea Orlando and Roberto Speranza, however, ask him to meet with the trade unions, to resolve the latest issues: the rule on the maximum discount, that on subcontracts, and the involvement of the social partners in the governance of the Recovery plan. And here are the key points of the decree.
Contracts, the limit of contracts without tender rises to 139 thousand euros
The reference to the maximum discount disappears from the draft and the 40% threshold of subcontracting returns, that is the ceiling of the works that those who win a tender can sell to others. The government intends to allow integrated procurement, in which the design and execution of the works can be entrusted to the same contractor.
There is a commitment to reduce contracting stations to a much lower number, improving the quality of the investment process.
The exceptions to the Canton Code introduced last summer by the Conte government are extended to 2023. The limit for contracts without tender for services and supplies rises from 75 thousand to 139 thousand euros, while the awarding of the works will be subject to a negotiated procedure for the amounts between 150 thousand and one million euros. For works over a million, at least ten operators will be consulted.
Broadband, authorization to install the fiber within 90 days
Halved times for laying the broadband. The draft pushes the administrative processes for telecommunications networks and ensures faster processes to extend the fast connection throughout Italy. The time required to obtain the necessary authorizations has been cut from six months to 90 days.
The Special Superintendence for the works of the Recovery plan arrives: it will be used to speed up permits, in compliance with landscape and archaeological protection.
The times for the Via, the environmental impact assessment, are accelerated, with the establishment of a sort of technical Pnrr-Pniec (Energy and Climate Plan) “supercommission” with 40 experts. Strengthened the mechanism of silent consent and the peremptory nature of the terms within which the administrations must respond, but not for the one-stop shop for construction and production activities.
Public administration, commissioners for local authorities who hold back the works
Access to public administration digital services will be easier for those unfamiliar with new technologies. Thanks to a new system, it will be easier to delegate bureaucratic obligations to a family member or an acquaintance who owns the Spid.
The government is preparing for a squeeze on local authorities and administrations: those who will not be able to meet the timing of the Recovery projects risk being replaced by “ad acta” commissioners.
The first step will be to give 15 days to remedy the delays: if the deadline is not met, the premier or the competent minister will trigger the replacement powers.
Sanctions for executives who hold back the transition to digital. Agid (the Agency for digital Italy) will supervise, which will have to report violations. Fines from 10 to 100 thousand euros are foreseen for those who fail to provide the requested data and documents.
Superbonus will also be extended to hotels and guesthouses
The 110% Superbonus is extended to properties with cadastral class D / 2, that is hotels and pensions. However, the standard enters and exits the drafts and will be examined in the Council of Ministers. However, enlargement remains one of the issues that the government is evaluating with the aim of facilitating the modernization of tourist facilities and helping the sector, one of the most affected by Covid.
The decree expects a series of directives to make green renovations more usable by condominiums, in particular avoiding blocking construction sites in the event of discrepancies and an ongoing request for amnesty of a single property.
On the other hand, the extension of the concession to 110% for optical fiber cabling works for access to ultra-broadband is confirmed, both for condominiums and private homes.
Recovery, three-level control room and common table for the super-piano
The direction of the national recovery and resilience plan is conceived on several levels: a political booth led by the premier who from time to time will involve the ministers concerned by subject and, where necessary, the governors of the Regions. There will also be a permanent table with the social partners.
Mario Draghi has created a technical secretariat to support the activities of the control room and the permanent table until 2026, which therefore goes beyond the duration of the legislature.
The secretariat will also have the task of informing the premier of the actions useful for overcoming critical issues.
350 recruitments of technicians with a legal, IT, statistical-mathematical and engineering profile are envisaged.
The companies involved in the Recovery investments will be rewarded, guaranteeing gender equality and opportunities for young people under 36 in contracts.
Environment, easier and less cost for wind
Wind easier with less costly procedures and a package of measures to support renewables. The rules established by last week’s draft on suitable areas, from the landscape point of view, where to build the renewable energy plants to be built in the various regions, have jumped from the text.
The simplifications for photovoltaic systems and for the production of electricity have been confirmed.
