The legislation on emergency agile work will be extended to 31 December also for the private sector, which thus aligns itself with the Public Administration. The novelty is contained in an amendment developed by the technicians of the Ministry of Labor, after the broad convergence achieved by the majority, to be submitted to decree law 52, ​​the so-called Reopening, currently being examined by the Chamber. The simplified regime for smart working – which, as is known, allows employers to be able to activate the tool with a unilateral act, without having to sign an individual agreement, as instead provided for by ordinary law, no. 81 of 2017 – was brought from the end of April to 31 July precisely by the Reopening decree, which extended the state of emergency to 31 July.

Emergency regulation until the end of the year

But the Minister of Labor, Andrea Orlando, immediately took action to investigate the issue; in Parliament the executive had expressly undertaken to extend the deadline at least until 30 September, in any case after the summer, accepting an agenda to that effect from Paolo Zangrillo (Fi), member of the Labor Commission of Montecitorio; and now, with the amendment of the Ministry of Labor, the hand moves forward by another three months, that is, until the end of the year.

3-5 million agile workers over the next few months

The theme is delicate, especially for the numbers involved. According to the first analyzes of the Observatory of the Politecnico di Milano and Randstad Research, in the coming months, agile work could affect an audience between 3 and 5 million workers, confirming itself as a tool that people like, and that has known, during the acute phase of the pandemic, combining productivity, safety and work-life balance (currently, INAP recalled, over 5 million employees are in agile work, 6.5 million during the first lockdown – 54% in large companies of employees lend their business, in whole or in part, “remotely”).

The ideal work week

In the “new” normality, in fact, the working week is also destined to change. The “ideal” one, according to a recent study by Fondirigenti, will no longer be entirely (or almost) “from home”, but it will be preferable to break the week into two: 2.6 days in attendance, the remaining 2.4 “at a distance” , also to recover social relationships and physical interaction with one’s work group, two central aspects, but which have been most lacking in these months of more or less generalized lockdown.

Nisini: giving companies and workers time to organize themselves

“The difficulties for companies will not end on July 31 with the end of the emergency state – underlined the Undersecretary for Labor, Tiziana Nisini (Lega) -. There are many companies still in great difficulty and for this there is a need for flexibility. The amendment extending the simplified legislation on agile work until December is right, also because it is linked to the vaccination plan which is progressing well. After the summer it is hoped to achieve herd immunity. We must give companies and workers time to organize themselves, without overdoing the bureaucracy ».
