BELLUNO. Schools begin to contend with staff who refuse to present the Green pass. A situation that worries school leaders, who do not know how to behave. The rule is not clear and the principals are afraid of facing any disputes.

The problem is denounced by the director of the Iti Segato-Brustolon of Belluno, Ilaria Chiarusi, who does not enter into the merits whether they are teachers or part of the administrative staff. «In the institute», he underlines, «there are some staff members, few to tell the truth, without the green certificate in order. For this reason they were not allowed in. ”

These workers thus skipped the first days of school: «In the meantime, let’s mark the absences, then we’ll see if they are justified or not. If not, the suspension will take effect after five days. But who is called to suspend these employees? ”Asks the principal, who will report the uncomfortable situation to the disciplinary measures office of the former Superintendent. «I don’t know what will happen, also because we are called to face a new situation. I am not convinced that it is up to the principal to draw up the suspension decree. It was statistically probable that such a thing could happen, but it is difficult to understand how to move ».

For the director of the provincial school office, Massimiliano Salvador, the law is clear: «The text of the decree law 111/2021 in article 1 paragraph 6 specifies that all school staff must possess and exhibit the green certification. Failure to comply with the provisions is considered unjustified absence, and starting from the fifth day of absence the employment relationship is suspended and not paid. Since the person in charge of verifying the prescriptions is the head teacher, he has the obligation to take the measures. Once completed, the suspension decree must be sent to the State Accounting Office. The law does not speak of disciplinary sanctions, ”says Salvador.

But the concern remains high. «We know that on the fifth day of absence due to lack of a Green Pass, the suspension is triggered, but there is no clarity about who should do what. The juridical case is new », also specifies Violetta Anesin of the Renier institute and of the Dolomieu hotelier. “We know that before the suspension of the employee for each day of absence there is an administrative sanction: as principals we must raise a sanction from 400 to 1000 euros. Fortunately, I have never had to make such a decision. ‘

Anesin prefers to prevent problems: «We do checks in the morning, if we see that someone is not up to date, we call him and invite him to go to the pharmacy to get a swab. In case of refusal, everything changes, but we principals still don’t know exactly how to move. I know that some colleague communicates absences to the prefect, but the ground is thorny: if we make a mistake, litigation starts ».

«However», concludes Anesin, «doing these checks involves a great waste of time. It shouldn’t be our job to impose fines everify Green pass. We should take care of school. It would be better if this were managed centrally ”.
