Trade unionists dismissed before Christmas, the judge orders 4 redemptions: discriminatory and retaliatory dismissals

Oclam had penalized and dismissed members of the Filcams-Cgil union: “Rights exist and exercise them is a must”

SAN MARTINO AL TAGLIAMENTO. On December 15, 2020, just before Christmas, in the year of the pandemic, they were fired. Six months later, the labor judge of the Pordenone court, Angelo Riccio Cobucci, ruled that those workers – four, one is still awaiting sentence – not only should not have been fired, but that their dismissal was “discriminatory”. This closes another page of a very delicate dispute that saw Oclam srl of San Martino al Tagliamento opposing on the one hand, five employees and Filcams Cgil on the other.

This is the second episode of a story that, last March 16, had led the trade union and workers to be recognized by the same judge for the anti-union behavior of Oclam, an important commercial reality of the medium distribution. The company had in fact reduced its employees from 21 to 11 for technical-organizational reasons, transferring part of the workers to a third company, but still belonging to the srl. For the judge it was a way to reduce the staff below 15 employees and therefore prohibit trade union activity. As part of that dispute, Filcams – assisted by lawyers Luigi Locatello and Lidia Benincà – denounced the forwarding of letters containing disciplinary disputes by the company, only to workers registered with the union. However, the judge declared the letters invalid and ineffective, an element that was also useful for contesting the dismissals.

Riccio Cobucci declared the dismissal null and void “as it is discriminatory for reasons of union affiliation and retaliation”. He then established the reinstatement of 4 applicants, full compensation for the arrears of monthly payments as well as legal fees to be paid by the company. “The courage of these workers deserves to be emphasized”, highlights the provincial secretary of Filcams Cgil Daniela Duz. “We have carried out a constant and incessant work, always making ourselves available to workers, Saturdays and Sundays, also thanks to lawyers who have shown competence and empathy for those who have been fired in a discriminatory way – highlights Marika Baio who followed the procedure for Filcams – . What has been achieved is an important result for all workers: rights exist and exercising them is a must ». –
