TREVISO. The prosecutor’s request was for a sentence of 4 years and 9 months. But the judges of the college went further, sentencing him to 6 years and 6 months in prison for having broken his partner’s spleen and for having approached her several times, despite the precautionary measure of the prohibition of approaching her on his head.

The accessory penalties are also heavy: perpetual disqualification from public office and sentencing to compensation to be quantified before the civil court but with a provisional payment of fifteen thousand euros. Instead, he was acquitted because the fact does not arise from the accusation of ill-treatment.

Thinking hand of the judges of the college (chaired by Umberto Donà) to a 45-year-old nurse from Treviso from Ca ‘Foncello (defended by the lawyer Stefano Pietrobon) who was on trial for a series of crimes that saw the hospital operator’s partner as an offended party (civil party with the lawyer Antonella Picco), a forty-year-old of foreign origin.

The man had ended up in the crosshairs of justice after a brutal attack, carried out, according to the prosecution, on September 18, 2019 when he was prey, as often happened, to the fumes of alcohol. At the culmination of a quarrel, which took place in the bathroom of the house, the nurse attacked her partner with kicks and pushes until her spleen ruptured, for which she was then admitted to the Treviso hospital where the organ was removed.

From that episode came a complaint from the woman for ill-treatment and serious injuries. Ill-treatment which, according to the complaint, would have been almost daily for seven long months, from February to September 2019.

Following the activation of the red code procedure that protects women victims of violence, the judge of the preliminary investigations ordered the precautionary measure of the prohibition of approaching women on the nurse. Measure that the nurse would have repeatedly disregarded so much so that he was arrested for violating the precautionary measure and then released from prison last October with the obligation to stay outside the region, in a place where he comes from.

The judges took 90 days to draw up the reasons that led them to heavily condemn the Treviso nurse.

For his part, his lawyer, the lawyer Pietrobon, will have the opportunity, after reading the reasons for the sentence, to challenge the sentence before the judges of the Court of Appeal to try to win, if not an acquittal, at least one significant reduction of sentence. Provided that the Venetian judges do not fully accept the reasons for the condemnation of colleagues of the first degree.
