Cos’è lo Right School

The proposed law on the “ius scholae” aims to modify the current legislation on the acquisition of Italian citizenship by a foreign citizen. The text intends to introduce the possibility for a non-Italian minor to request it until after completion of at least a 5-year school cycle.

The measure was changed during the examination in committee: the condition of the “positive” conclusion of the 5 years of elementary school to obtain citizenship was added. The amendment was also approved which introduces the possibility of also considering professional training courses to acquire the right. The requirement that the request must be submitted by both parents has been eliminated (therefore in theory it is now sufficient for one of the two to submit the application). Another important change after the work of the Commission is the elimination from the text of the requirement of “uninterrupted” residence in Italy.

Requirements

Italian citizenship can be acquired by the minor foreigner born in Italy or who entered it within the twelfth year of ageto. The minor must legally reside in Italy and must have regularly attended, in the national territory, for at least five years, one or more school cycles at institutions belonging to the national education system or vocational education and training courses suitable for obtaining a professional qualification. In the event that attendance concerns primary school, the successful conclusion of the course is also required. The requirement of a minor age is considered to be referred to the moment of submitting the application or request by one of the parents or whoever exercises parental responsibility.

The question

Citizenship is acquired following a declaration of will expressed in this sense, by a parent legally resident in Italy or by whoever exercises parental responsibility, to the registrar of the municipality of residence of the minor. Within two years of reaching the age of majority, the interested party can renounce Italian citizenship if in possession of another citizenship. If the declaration of will has not been expressed, the interested party acquires citizenship if he / she requests it from the registrar within two years of reaching the age of majority.

The process of the proposal

The one encountered by the proposed law on the Ius Scholae is an obstacle course. On the one hand the supporters of the provision, center-left and M5s, on the other the detractors with Lega and Fratelli d’Italia right from the start against the measure. Forza Italia initially voted in favor on the occasion of the adoption of the basic text, and then expressed itself against it when the Constitutional Affairs Commission dismissed the provision for the Chamber. And this is the “forcing” of the Pd and M5s that infuriated the League, leading Molinari to threaten his exit from the government.
