Rome, 3 August 2021 – Green light for the Camera at the Justice reform of the minister Cartabia. There were 396 votes in favor, 57 against and 3 abstentions. After five months of work, drafts, revisions, tests of strength and a three-day stream of votes, the reform of the criminal trial wanted by Mario Draghi and signed by Marta Cartabia passes in the late evening with the vote of the House, a vote that seems regroup the majority and largely also the 5 Star Movement. A final rush faced in August, but to impose the tight deadlines it is the EU, which in the NRP has linked the arrival of the Recovery plan funds to the drastic reduction in the times of criminal trials in Italy (-25% in five years).
A ride that only in the last three days passed for the preliminary ruling on Sunday, for the double confidence in the night between Monday and Tuesday and one very long day in the classroom which began today at nine in the morning for the discussion of the agendas for the text of the reforms, which have repeatedly tested the resistance of the majority. First on the subject of the civil liability of magistrates raised by Fdi. on which Lega, Forza Italia and Coraggio Italia have announced the abstention despite the contrary opinion of the government, causing the reaction of Pd and Leu. Then on ecoreati for which the classroom splits, especially on the reformulation of the agenda on the subject that ends up not passing only on the wool thread, rejected by the majority with 186 votes against 181.
I “and” the reform comes from Più Europa, Noi con Italia, Liberi equuali, Coraggio Italia then Pd (“our contribution was decisive for an innovative reform”, says Alfredo Bazoli), Lega (“it is the return of good sense and civilization “says Roberto Turri) and M5s (” I do not intend to respond to any provocation, because justice is not a personal matter “, begins the ex-keeper, Alfonso Bonafede).
They were though 16 the absent in the Chamber not on mission among the deputies of M5s on the occasion of the vote on the Cartabia reform. In the Movement, moreover, in two voted against the provision: they are Luca Frusone and Giovanni Vianelli. For the League the non-participants in the vote were 23, for Come on Italy 26. This is the result of the voting records. In the League it is explained that 13 are ill or in quarantine and the absences do not derive from problems with the reform. Non-voters in the Pd were 14.
In September the text will pass in the Senate to become law, but the first ok also scores a win for Giuseppe Conte who did not like the defections of the Movement on Sunday (about 25%) nor the dissonant vote of Alessandro Melicchio on the preliminary rulings of constitutionality presented by the opposition.
Between knots on which the negotiations and clashes of the last few weeks have taken place, first of all the prescription procedural: on appeal, according to the reform, the processes will have to last two years and in the Supreme Court one, with the possibility that the more complex proceedings reach up to three years and 18 months respectively. The agreement reached in recent days provides for further extensions of one year for the more serious crimes such as mafia, terrorism, sexual violence and drug trafficking, established by the judge. While it remains there non-prescription for crimes punishable with life imprisonment. On the other hand, the convictions for minor offenses are unappealable.
We then look at punishment in a different way, with the use of socially useful work unpaid, house arrest or semi-release with night return, for the most minor convictions and crimes. And the detention is also reviewed with a wide opening to alternative sanctions and with hiring and training for prison staff, a solution even more felt by Minister Cartabia after her visit to the prison of Santa Maria Capua Vetere, the scene of beatings to inmates in 2020.
Finally strengthening of the magistrate staff which becomes the weapon to speed up the criminal process by 25% and the civil one by 40%, with the assumption fixed-term contract in the next 5 years of 21,910 people.
