Serie A, Sky asks to block the assignment of TV rights to Dazn

The announcement for the assignment of audiovisual rights for Serie A for the next three years ends in court. According to Sole 24 Ore, Sky presented an urgent appeal (pursuant to article 700) to the Court of Milan to block the assignment to Dazn in partnership with Tim decided by Lega Serie A on March 26th.

All this on the eve of the Lega assembly which tomorrow, Friday 23 April 2021, will be called to give the green light to the formulation of the new call for the assignment of the 3 co-exclusive matches on all the platforms that have not been awarded to Sky last March 29, the day of deadline for offers.

The hearing is scheduled for 11 am on May 5th. The judge who will deal with it, who has recently entered the Business Section of the Court of Milan, is Federico Rolfi. The request was presented by Sky’s lawyers who pointed the finger at what is assessed as a disproportionate distribution of audiovisual packages decided by the League. With the assignment to Dazn – this is the thesis at the basis of the appeal – it is as if an exclusive power has been transferred over all the games to the Ott platform.

All this because Dazn in partnership with Tim has been assigned 7 exclusive games per week on all platforms (package 1) and 3 co-exclusive games on Iptv (package 3). In this way, according to the thesis at the basis of the appeal, a monopoly in the television offering was in fact created, prohibited by the rules of the Melandri law and the rules on antitrust matters.

With this thesis, considering therefore also package 2 being defined by Lega Serie A as not able to counterbalance what is branded as an enormous market power that Dazn would achieve with the license on the seven exclusive matches already assigned, it was the appeal was presented, with a hearing set for 5 May.
