Canada, a No Vax father loses the right to see his son

NEW YORK – Either you get vaccinated or you won’t be able to see your child. From the Canadian province of Quebec, where they have decided to tax the “novax”, another harsh signal comes. A father opposed to the Covid vaccine has lost the right to be with his 12-year-old son unless he decides to get immunized. This was established by a judge of the Superior Court of Quebec, a French-speaking province of Canada, who defined the measure “taken in the name of the best interest” of the minor.

The decision dates back to December 23 but is now out in the Canadian media. The man will not be able to visit his son at least until February. “It would not be in the child’s best interest – Judge Jean-Sébastien Vaillancourt wrote in the provision – to be able to have contact with the father who is not vaccinated and has opposed health measures in the current epidemiological context”. The reference is to the Covid pandemic and the new emergency situation linked to the Omicron variant which in Canada has registered a peak of infections, and in particular in the province of Quebec where 90 percent of adults are vaccinated.

The case of the father novax ended up in court after he, separated from his wife, had asked to be able to stay with his son one more day than established, just during the Christmas holidays. The ex-wife had opposed after discovering that he had not been vaccinated and had expressed his conspiratorial positions on social media. The man confirmed that he was not vaccinated and had “reservations” about the therapy but also that he had “respected health standards” and had “rarely” left the house. The ex-wife, however, produced extracts from the conspiracy post published by the man on Facebook in the courtroom.

“Seeing the tenor of the messages – commented the judge, addressing the man – this court has strong reasons to doubt that you can comply with health standards”. The judge added that while the child is vaccinated, immune protection “appears to be reduced against the Omicron variant, which is spreading in Quebec.” The ex-wife lives with her new partner and two other children, aged seven months and four, too young to be vaccinated. In Canada, the minimum age to be vaccinated against Covid is five years. “Given the circumstances – added the judge – it is not in the interest of any of the three children to receive a visit from an unvaccinated adult”.

In an attempt to contain the outbreaks, the Quebec government announced a series of measures such as a 10pm curfew and a ban on indoor gatherings. But the most severe measure concerns the one announced by Prime Minister François Legault who, on Tuesday, announced the introduction of a form of taxation for novaxes. “All people who have not been vaccinated for non-medical reasons – he said – will have to pay a contribution”. Legault did not explain how much it will amount but did speak of a “significant contribution”. “I think it is a question of fairness – he added – towards the ninety percent of the population who made sacrifices”.

The message was described as “encouraging” by the Minister of Health, Christian Dubé, who said that on the same day as Legault’s announcement, there was a boom in vaccinations. Canadian Prime Minister Justin Trudeau said he will not comment on the decision, but admitted he wants to see how it works. In the case of the father novax, the judge will review the situation again at a hearing scheduled for February 8. If he entered that date he will not be vaccinated, he will continue not to be able to see his son. And, probably, in the meantime, he will have had to pay a “contribution” in cash.
