Hungary, Orban sided with Poland: “National law prevails over European law”

The Hungarian premier, Viktor Orban, sided with the decision of the Polish Constitutional Court which expressed the incompatibility between the national constitution and parts of EU law.

“The decision of the Polish Constitutional Court – reads a Hungarian government document signed by the premier – was motivated by the bad practice of the European institutions that disregard the principle of delegation and try to deprive member states of powers that they have never transferred to the ‘European Union”.

In the decree signed today, Orban affirms that Poland’s sentence is due “to the bad practices of the European institutions, which do not respect the principle of subsidiarity and try to deprive the rights of the member states, rights never conferred on the European Union”.

“The institutions of the European community therefore have the duty – we read – to respect the national identities of the member countries”. The president of the European Parliament, David Sassoli, is not of the same opinion. In an interview with Repubblica, he declared: «The decision of the Polish court is worrying. The supremacy of the European treaties is indisputable. I hope that there is still the possibility of avoiding an irreversible crisis. However, it must be clear that the primacy of European law over national law cannot be called into question ”.
