Jakarta – The President’s Special Staff for Early Legal Affairs, Purwono, responded to the news that Jakarta had lost its status as a Special Capital Region (DKI) as a result of the enactment of the Archipelago Capital Law.

He emphasized that DKI Jakarta still had the status of the capital of Indonesia until now until the Presidential Decree on the transfer of IKN to the archipelago was issued.

“Based on Article 39 of the IKN Law, DKI Jakarta remains the National Capital until the issuance of the Presidential Decree on the transfer of IKN to the Archipelago,” he said, in a written statement, quoted Thursday, March 7 2024.

Regarding when the Presidential Decree will be issued, he said it is entirely under the authority of President Joko Widodo (Jokowi).

“Exactly when the presidential decree will be issued depends entirely on the authority of the President,” said Dini in his written statement, Thursday (7/3).

This means that IKN will legally become the country’s capital when the Presidential Decree is issued.

He continued, the issuance of the Presidential Decree itself does not require waiting for the Jakarta Special Region Bill (DKJ) to be drafted. He emphasized that there would be no legal vacuum in Jakarta if the Presidential Decree was issued before the DKJ Bill was passed.

This, he said, has been regulated in Article 41 of the IKN Law, that since the Presidential Decree on the transfer of IKN to the archipelago has been stipulated, the provisions of Article 3, Article 4 except for its function as an autonomous region.

And Article 5 of Law Number 29 of 2007 concerning the Provincial Government of the Special Capital Region of Jakarta as the Capital of the Unitary State of the Republic of Indonesia is revoked and declared invalid.

“So only certain articles in the DKI Jakarta Law will be repealed, not the entire law,” he concluded.
