The latest survey report of the NSW Property Management Community Association (SCA) shows that waterproofing (23%) is the most common major defect in new apartment buildings, followed by fire safety (14%) defects. Almost one in ten buildings has structural and wall defects, such as roofs or exterior walls.

This investigation is part of a joint operation between the NSW Building Commissioner’s Office and the NSW Management Community Association. 1,400 property management managers participated in the survey, each of whom managed residential buildings of four or more floors built in the past year.

The survey also found that resolving the defects of the building is a protracted process, and for 38% of the owners’ corporate bodies, it takes 12 months or more to reach a conclusion.

The most common obstacles to solving deficiencies are funding (15%), lack of awareness of rights and responsibilities (14%), and disagreements among owners’ corporations on the solutions that should be adopted (10%). The most common way to resolve defects is to reach an agreement with a developer or builder (27%).

However, the investigation also found that only seven buildings reported that the costs incurred during the defect repair process could be recovered.

NSW Construction Commissioner David Chandler said that the purpose of the investigation is to understand how common building defects are in NSW and how to solve them.

He said that major architectural defects are not just the high-profile cases of Opal Tower and Mascot Tower, but a common problem.

Chandler said that with this evidence, he was able to tell the real estate development lobby Urban Taskforce or the Urban Development Institute of Australia (UDIA), “You can’t say that this is not a big problem.”

The survey showed that only 15% of buildings with serious defects were reported to the NSW Fair Trade Department, and the effect of filing a lawsuit in the NSW Civil and Administrative Court or the Supreme Court was even worse. Only 5% of the cases had results. .

Chandler admitted that in the past, many property legal entities had no confidence in the handling of flaws in the Department of Fair Trade.

“You have to win back the confidence of these corporate bodies. 15% of the results are not good enough. The main reason is that we don’t know about 85% of the cases,” he said.

He said that in the past year, the Office of Fair Trade has hired new technicians and introduced a new process in its compliance and complaint handling department. Construction complaints can now be handled more effectively than ever.

The Owners Corporation Network, a non-profit organization representing apartment owners, welcomed the findings.

In the next 6 to 10 years, this survey will be conducted once a year to measure the improvement of relevant departments and build public confidence in apartment buildings.
