The Court of Poland v Brussels: “Some EU rules violate our Constitution”

BRUSSELS – The clash is unprecedented. Poland appears to be taking a step towards exiting the European Union. For the first time, an EU member state solemnly declares that the supremacy of the European Treaties over the Polish Constitution does not exist. Essentially questioning the architrave on which membership of the Union rests. Specifically, the Constitutional Court of Warsaw refers to the competences of the Polish state that have not been transferred to the bodies of the European Union.
