L’Agcom approved the resolution for new wholesale tariffs for access to the Telecom network, confirming the system planned in the consultation phase for the period 2024-28. The main novelty, second Radiocorconcerns a reduction expected for i copper network access prices as desired by the operators competing with the ex-monopolist. In 2023 the Authority had instead decided to increase the costs of access to the copper network (which still represents today the majority of Telecom’s infrastructure) which would have favored, for Tim, an increase in revenues of 50 million euros. Now, however, with the expected transfer of the network to the KKR fund and the Italian government, the decision to lower access tariffs to the copper network will no longer affect the accounts of the former monopolist.

The measure will have to be notified to the EU

The opinion of theAntitrust to then notify the provision to the EU where, in recent days, the Authority received notification of the operation to unbundle the network Tim, which does not affect price regulation for the moment. Indeed this process continues, in parallel with the ongoing separation of the infrastructure. In the draft provision that was put up for consultation, the general structure of which is confirmed, the contained analysis carried out by Agcom has demonstrated that the network access services market wholesale is competitive and, as such, no longer susceptible to regulation.

For the fiber network, already competitive areas have been identified

In fact, areas of the country that are fully competitive in terms of manufacturing have been identified fiber network, in which the regulatory obligations of Tim are removed, with respect to areas of the rest of Italy in which Tim’s position of significant market power (together with its subsidiary) is confirmed Fibercop) and, consequently, the imposition of the measures provided for by the code. Some areas have also been identified, i.e. contestable municipalities, in which, since significant competitive pressure has been found, only the obligation to control prices for some services has been alleviated.

Reduction of regulatory constraints with the transfer of the network

It should be underlined that in the note of Last November 5th with which Tim had announced the sale of the network it was written that the operation “in addition to reducing debt and freeing up resources, will have the opportunity to encourage the reduction of some regulatory constraints in the domestic fixed and mobile telephony market”.
