Overhanging balcony that is leaking, what to do if the owner does not intervene?

The issue of ownership of projecting balconies is not expressly dealt with by the civil code. The only indication of the law in this regard is related to the fact that the balconies do not fall within the list of common goods contained in Article 1117 as the balconies themselves are not accessible to all condominiums and do not perform any function other than that of guarantee the view to the owner of the apartment served by the balcony itself.
