Feminicides, after the case of Senago, the CDM launches the squeeze: this is what the strengthened “Red Code” provides

No more feminicides: after the tragedy in Senago in which the young pregnant Giulia Tramontano was murdered, and which greatly shocked public opinion, the government approved a bill today in the Council of Ministers to intervene urgently on the issue, in perspective of both punishment and prevention. The objective of the government’s intervention, as far as we learn, is to make the measures of the already existing “Red Code” even more severe: the penalties for violent men should therefore increase, while at the same time the aim is to speed up the times of justice, and to strengthen precautionary measures. Fifteen articles, the result of the joint work of three ministers: Eugenia Roccella, Carlo Nordio and Matteo Piantedosi. The first of them, as reported by the Corriere della Serais dedicated to repeat offenders.

Exacerbated penalties, accelerated times

The penalties are increased if the crime occurs in the context of domestic violence, and if it concerns the crimes of violence, personal injury, private violence, threats, persecution, revenge porn. Furthermore, the application of the electronic bracelet is expanded: it becomes automatic and is no longer at the discretion of the judge, although it always requires the consent of the suspect. For requests for precautionary measures, as well as for their application by the investigating judge, a time limit of thirty days is set. Clearer parameters are also set with regard to the prohibition of approaching: violent men will have to keep a minimum distance of 500 meters from the victim and from the places she frequents.

Anyone who violates this limit will face imprisonment from one to five years. And deferred arrest is also allowed, i.e. the possibility of demonstrating the fact with videos, photos, electronic media, provided that it is within 48 hours of the fact. Finally, with a view to strengthening prevention, the range of application of the warning is extended and the measure of special surveillance is introduced: not only for stalking and ill-treatment, but also for attempted murder, revenge porn, acid attacks. Anyone who commits a crime having already received a warning will face increased penalties.
