The Privacy Guarantor blocks Mitiga, the app to go to the stadium

The Guarantor for the protection of personal data has ordered the temporary blocking of the processing of personal data towards the company that manages the Mitiga Italia app. The app was used for the first time on May 19th to allow entry to the Coppa Italia final Atalanta-Juventus of spectators in possession of certification certifying vaccination, recovery or negativity from Covid-19.

The reasons for the blockade
The measure was made necessary since the possibility emerged that the app, in the coming days, could be used to govern access to other events and shows or other sporting initiatives. In his provision, the Guarantor stressed that at the moment there is no valid legal basis for the processing of data, even particularly delicate ones such as those of a health nature, carried out through the app and aimed at ascertaining the “ Covid free ” situation of those who participate in sporting events as well as other public events or access premises open to the public. Finally, the Mitiga company, having submitted the application to the Authority on 1 April, should in any case have refrained from any processing of data since the time provided for by the Regulations for taking a decision by the Authority itself did not elapse. The block has immediate effect and will continue for the time necessary to allow the Authority to define the investigation initiated.

How does it work
Once the app is installed, you need to register, then you can use it to generate a QR code, a sort of unofficial Green Pass that certifies the negative outcome of the swab done previously at an authorized center. Those who are vaccinated, on the other hand, must declare that they are vaccinated by going under the Profile heading, clicking on Health declaration and finally choosing the most suitable option. To access you must show the certificate, together with an identity document.

The supervisor’s comment
“Mitiga cannot first submit an application to the authority saying that the treatment it intends to implement presents risks and then start the same treatment without waiting for the opinion that you asked us”, explains the Guarantor. But there is more: to date, access to a show cannot be subordinated to the performance of a green certification, because the regulatory framework is limp and incomplete (the decree law 52 in relation to which we made the famous warning to the Government). Then in the coming weeks we will look deeper into Mitiga and understand if, in a different way, it can stand up ”.
