In fact, they will be arrested in flagrant status. This is what is foreseen by an amendment to the reform of the criminal trial presented by Iv, first signatory Lucia Annibali, to whom the government and the rapporteur Franco Vazio have given a favorable opinion and therefore towards the approval in the Justice Commission in the Chamber.
The new rules on the prohibition of approach
These are violations that since 2001 have been prosecuted as autonomous offenses, no longer as aggravating circumstances, but which until now did not provide for arrest in the act of crime. Arrest in flagrantee is currently foreseen for ill-treatment against family members and cohabitants, and also for the crime of stalking. For those who violated the prohibition of approaching the handcuffs were not expected to be released, detention only came at the end of a possible trial. “These are situations – commented Annibali – that unfortunately have occurred frequently in episodes of violence against women by ex-husbands or former companions”.

Victims of femicide
The arrest the flagrant therefore avoids that the “ex” from the threat passes to the facts with tragic results, as happened in the past. Unfortunately, the number of women victims of femicide is always very high. On the basis of the data provided by the Interior Ministry for the period between 1 January and 25 July 2021, “157 homicides were recorded, with 64 female victims, of which 56 were killed in the family / affective context; of these, 39 found death at the hands of the partner / former partner ».
Furthermore, according to a report carried out by Istat and published last February during the lockdown there was a sharp increase in domestic violence that resulted in murder. In the first 6 months of 2020, the situation worsened further with a number of crimes equal to 45% of the total homicides, compared to 35% in the first six months of 2019. The percentage then jumped to 50% during the forced stay at home. for Covid in March and April last year. A trail of blood continued without interruption, given that in 2019 the number of femicides had reached 101 and in 2018 the percentage of men accused of murder was 93%.
According to the Institute of Statistics, women were killed within the home – therefore in an emotional / family context – in 90% of cases in the first half of 2020 at the hands of partners or former partners (61%). And, apart from the negative exceptionality of the lockdown phase, the gloomy overview of femicides finds a temporal red thread with the 2019 data, which confirm a general decline in homicides and a decisive counter-trend of those perpetrated in the family. In 2019, Istat records, the murders were 315 (345 in 2018) of which 204 men and 111 women. And also in that year in the family or emotional sphere the number of victims increased: 150 in 2019 (47.5% of the total), with 93 victims women (83.8% of the total of female murders).
