Sharing the arguments of the prosecutor, the judge states that against the mayor “no omissive conduct in causal relationship with the injuries suffered by the child has been identified”, nor has it been possible to configure a specific or generic fault in the first citizen “, especially considering that, not being aware of the concrete organization of the municipal nursery spaces, functional to the subdivision into ‘bubbles’ (and a fortiori of the presence of a fire door in one of the classrooms) “. At the head of the mayor it was not “foreseeable or avoidable what happened”. (HANDLE).
