On Wednesday (20/2/2024) the family of the late Brigadier J filed a civil lawsuit regarding the death resulting from premeditated murder which occurred at the National Police Service Residence Duren Tiga 46 South Jakarta 2022.

Represented by the parents of the late Grigadir J, Samuel Hutabarat and Rosi Simanjuntak, they are demanding compensation for material losses worth IDR 7.5 billion and IDR 500 billion from the convicts Ferdy Sambo, Putri Candrawathi, Richard Eliezer (RE), Ricky Rizal (RR), and Kuat Maruf (KM), the perpetrator of the murder, and the National Police as the defendant.

Reporting from Beritasatu, The first trial of the lawsuit by the family of the late Brigadier J in the shooting case committed by Ferdy Sambo was supposed to start on Tuesday (27/2/2024). The defendants, Ferdy Sambo, Putri Chandrawathi, Kuwat Ma’ruf and Ricky Rizal, were unable to attend the trial, so the trial was postponed by the South Jakarta District Court (Jaksel). The trial was postponed for three weeks and is scheduled to be held on March 19 2024.

Chronology of the Case that Ensnared Ferdy Sambo

On Friday (8/7/2022) Ferdi Sambo (FS) reported the incident of Brigadier J’s death to the South Jakarta Metro Police and the Propam Division of the National Police Headquarters. Initial chronology, Brigadier J is suspected of molesting Putri Candrawathi at the Duren Tiga Official Home. Then at that time, Bharada E, who was trying to reprimand Brigadier J, was shot, resulting in a shootout that killed Brigadier J.

FS contacted the South Jakarta Police Criminal Investigation Unit Head at 17.30 WIB. Then, at 17.47 WIB, Propam came to the crime scene and was contacted by Brother FS. After completing data collection and securing evidence, at around 19.00 WIB the witnesses who were at the crime scene at that time, Kuwat Ma’ruf, Brigadier RR, Bharada E were taken to the Paminal Bureau office at Propam for interrogation.

The crime scene investigation was completed at 19.40 WIB. The deceased’s body was taken to Bhayangkara Hospital level 1 and arrived at around 20.20 WIB. The external inspection operation began at 22.30 WIB and continued with an internal inspection which ended on Saturday, July 9 2022 at around 02.00 WIB.

At around 11.00 WIB, South Jakarta Metro Police investigators went to the Paminal Bureau Office at Propam to make a report on the examination of the three witnesses. However, investigators received intervention from personnel from the National Police’s National Police’s Internal Affairs Div Propam Bureau. Investigators are only permitted to change the format of the interrogation minutes conducted by the Propam Div Paminal Bureau into examination minutes.

At 13.00 WIB, investigators and witnesses were directed by Propam Div personnel to reconstruct the incident at the crime scene. After completing the reconstruction, the witnesses headed to FS’s house in Saguling. Members of the National Police’s Propam Div Paminal Bureau at the same time combed the crime scene and ordered to replace the CCTV hard disk which was at the Duren Tiga Post. This CCTV hard disk was then secured by personnel from the National Police Propam Div.

The family was not allowed to see the condition of the body and refused to sign the handover report. This resulted in people asking more and more questions and reports appearing regarding irregularities in Brigadier J’s death.

Ferdy Sambo’s death sentence becomes a life sentence

In the matter of the sentence handed down for Ferdy Sambo, the Supreme Court had two considerations used by the cassation panel of judges in deciding Ferdy Sambo’s case.

1. Law no. 1 of 2023 Criminal Code

By paying attention to the objectives and guidelines for punishment according to criminal law science, as well as the politics of national criminal law after the enactment of Law No. 1 of 2023 concerning the National Criminal Code (KUHP). In the latest Criminal Code, the death penalty is seen as a special crime, no longer as a basic crime. In this way, the politics of criminal law in force in Indonesia shifts from retributive to rehabilitative. Current punishment prioritizes the aim of punishment as a means of prevention, correction/rehabilitation, conflict resolution/restoration of balance, creation of a sense of security and peace as well as fostering remorse for the convict.

2. Article 8 paragraph (2) Law No. 48 of 2009 concerning Judicial Power

This article states, “In considering the severity of the crime, the judge must also pay attention to the good and evil characteristics of the defendant.” This includes the defendant’s life history and social situation.

During his tenure as a member of the National Police with the last position being Head of the Professional and Security Division (Kadiv) (Propam), Ferdy Sambo has served the country by contributing to maintaining order and security and upholding the law in the country for 30 years.

Details of Ferdy Sambo’s assets

Even though he has the status of a state official with the rank of two-star general, in fact Ferdy Sambo has never reported his assets (LHKPN) to the Corruption Eradication Commission. The reason is, Sambo’s assets are not on the e-site.LHKPN Corruption Eradication Commission. Party KPK himself explained that several of Ferdy Sambo’s documents were incomplete, so data on his assets could not be widely published.

Sambo is known to own several cars, such as the Lexus RX300, Lexus LX 570 F-Sport, Toyota Land Cruiser, Lexus NX300 F-Sport, and Lexus LM 350 as well as the Toyota Innova Venturer with a total price of IDR 11.15 billion.

Not only that, Sambo also owns three houses in various elite areas. His two private houses are in the Saguling and Bangka areas of South Jakarta.
