A report about a meeting between right-wing extremists and entrepreneurs, AfD and CDU members in Potsdam has caused outrage. In the dispute over the representation, the Hamburg Regional Court decided on lawsuits brought by Ulrich Vosgerau (CDU) – and in some cases against him.
The lawyer Vosgerau had sued the press chamber of the Hamburg regional court against the reporting by the research network “Correctiv”. In its decision announced on Tuesday, the court only found the plaintiff right on one of three points.
What caused outrage was the fact that the participants at the meeting in Potsdam last November were said to have discussed so-called remigration. So the expulsion of people with a migration background from Germany. The research network “Correctiv” reported on this. Vosgerau does not see himself represented correctly in this. He had applied for an injunction against individual statements.
The court agreed on one point
A court spokesman said on Tuesday that the media company misrepresented the applicant in one passage in its report from January 10th. The report said that Vosgerau considered the suggestion that “a sample letter could be developed before the coming elections to cast doubt on the legality of elections as conceivable: the more people take part, he agrees, the higher the probability of success.”
The lawyer made it clear in his application to the court that he was not in favor of mass action. On the other hand, “Correctiv” did not specifically present Vosgerau’s statements on the topic. In its decision of February 26th, the chamber assumed that the quote was incorrect, it was said. Vosgerau is entitled to an injunctive relief.
The court ruled against the plaintiff on two points
The applicant was unsuccessful in court on two further points. On the one hand, “Correctiv” asked him before the article was published how he felt about the Potsdam debate about so-called remigration. Vosgerau claimed that his answer was not reproduced correctly. Yes, the regional court now ruled. Whether and what was discussed at the meeting in Potsdam about so-called remigration was expressly not the subject of the court decision.
On the other hand, the regional court dealt with the statement by “Correctiv” that Vosgerau had spoken about “concerns regarding young voters of Turkish origin who were unable to form an independent opinion” in connection with postal votes and subsequently confirmed this. The court ruled that the media company had summarized Vosgerau’s answer to a query in a permissible manner.
Objection to interim injunction possible
“Correctiv” can appeal against the interim injunction. The regional court would then have to decide again based on an oral hearing. Vosgerau can lodge an immediate complaint if his application was unsuccessful. In this case, the Hanseatic Higher Regional Court would have to deal with the dispute.
