The President of the Court of Appeal of Palermo in his “Report on the administration of justice in the year 2023”, after having reported the growth trend of the sums paid for the use of legal aid, correctly highlighted that “on the increase in spending significantly affects the strong economic crisis that afflicts, especially after the pandemic, the areas that are part of the district with consequent growth in pockets of poverty and greater difficulty in accessing jurisdiction which, however, must always be ensured in implementation of the constitutional principles”. However, we cannot agree with the next passage of the report which states the need to be vigilant “to avoid possible application distortions completely extraneous to the function of the institute, which end up transforming it from a noble and irreplaceable instrument guarantee in an anomalous form of income support for a part of the Forum”. It is not the first time that the President of the Court of Appeal of Palermo expresses this very personal assessment of his (a similar statement is contained in the reports from 2018 onwards): however, the fact of re-proposing it every year does not make it any less inappropriate and wrong. inappropriate because any abuses must be identified and reported by those who have the tools to do so: these are, at most, isolated cases attributable to individual conduct and not to “a part of the Forum”. It is wrong because it does not take into account that, as emerges from the same report, the volumes have reduced in the civil sector, while they are growing in the criminal sector, where citizens have no power of impulse, defending themselves from the accusations made by the PM, and where, moreover, admission to the Institute is by the judicial authority. The reality, as correctly highlighted in the same report, is that access to this fundamental guarantee institute FOR CITIZENS NOT FOR LAWYERS grows inversely proportional to the income and capital capacity of the territory. If that territory has its own specificities (for example, a strong presence of non-EU citizens) the reasons for the large number of beneficiaries can be understood without resorting to ungenerous conspiracy theories.
