On July 6, the official public account “Shenzhen Announcement” of the Information Office of the Shenzhen Municipal People’s Government announced that the “Regulations on the Administration of Intelligent Connected Vehicles in Shenzhen Special Economic Zone” (referred to as the “Regulations”) will be implemented from August 1. It is reported that this is the first domestic regulation on the management of intelligent networked vehicles, which specifically stipulates the definition of automatic driving of intelligent networked vehicles, market access rules, road rights, and identification of rights and responsibilities. The agency stated that the “Regulations” provide a reference standard for autonomous driving access policies in other cities across the country, and the process of my country’s autonomous driving legislation is expected to accelerate.

Introduce entry criteria

In terms of the access management system, the “Regulations” require that the Shenzhen Municipal Department of Industry and Information Technology shall, according to the application of the manufacturer of the ICV product, list the ICV products that meet the local standards of Shenzhen in the Shenzhen ICV. product list. In order to avoid the impact of automatic driving on the current road traffic order and to alleviate the concerns of all walks of life, the Regulations stipulate the safety reminder rules for intelligent networked vehicles, requiring vehicles to be equipped with external indicators of automatic driving mode and drive in automatic driving mode. The indicator light should be turned on to send obvious safety reminders to other vehicles and pedestrians.

At the same time, the “Regulations” divide ICVs into three types: conditional autonomous driving, highly autonomous driving, and fully autonomous driving, and clarifies the obligations of ICV drivers to take over. Drivers of conditionally autonomous driving and highly autonomous driving ICVs should respond to the takeover request and immediately take over the vehicle when the automated driving system makes a dynamic driving task takeover request.

In addition, with regard to the determination of responsibility for autonomous driving traffic accidents, the “Regulations” stipulate that, first, if an intelligent networked vehicle with a driver has a traffic violation or a responsible accident, the driver shall bear the responsibility for the violation and compensation; In the event of a traffic violation or a responsible accident in an ICV without a driver, in principle, the owner and manager of the vehicle shall bear the liability for the violation and compensation, but the relevant provisions on driver points shall not apply to the punishment of the offender; three In a traffic accident, if the damage is caused by the defect of the intelligent networked vehicle, the driver or owner or manager of the vehicle may request compensation from the manufacturer or seller in accordance with the law after making compensation in accordance with the above provisions.
