The European Commission has announced that it intends to take legal action against Germany in relation to the ruling of the German Constitutional Court which had challenged the supremacy of EU law over national legislation in relation to the stimulus program launched by the European Central Bank. In May 2020, the Karlsruhe court ruled that ECB-led purchases were to be considered illegal under German law unless the central bank could prove they were justified. The German ruling ran counter to a previous decision by the EU Court of Justice, in what was seen as an unprecedented “legal challenge” that could have prompted other countries to challenge the supremacy of EU law.
