Instead of calculating the toll solely on the basis of the infrastructure costs – i.e. the costs incurred for the construction, operation, maintenance and expansion of the affected transport network – the federal government also took into account the costs for the traffic police. And if that wasn’t enough, the court complained that even the calculation of the costs for the traffic police was flawed. The federal government also included expenses “for completing other tasks”. It is as if the fulfillment of a mandatory state task, such as maintaining the police, could be refinanced through road user fees.
