The Court of Naples rejected the appeal for anti-union conduct presented by Fim Fiom and Uilm against Whrilpool for the closure of the site in via Argine in Naples. The decision – expected for a few days – effectively makes the dismissal of the 320 workers of the Campania plant enforceable. The sentence came this morning a few hours before the start of the assembly convened by the unions at the Naples site and supported by a 2-hour strike at the end of the shift at the Cassinetta plant in Varese.

After a dispute that lasted two years, the dismissals started, the validity of which was confirmed by the sentence of the Court of Naples. Yesterday, November 3, the company sent dismissal letters to around 300 workers. In the letters, the multinational of whites, while formalizing the end of the employment relationship, leaves open, until November 30, the possibility of an alternative to dismissal: accept a voluntary retirement incentive equal to 85 thousand euros, or accept the possibility of keep the job with the transfer to the Cassinetta site in the province of Varese.

“For the judge of the Court of Naples, it must be considered that the behavior of the defendant, who has not continued in investments since May 2019, as required by the plan, and which has ceased production activity, is not an expression of anti-unionism. on the site from 1st November 2020 ». But it is a question of “the expression of the right of freedom of economic initiative provided for in the Constitution which, although it may be subject to limits for social reasons, cannot be bound except by the will of the person entitled”, reads the sentence.
