Italian Tech sends me, the right to online applications and to a digital home

Any application or declaration can be transmitted electronically, provided the sender can be identified with certainty.

Online instances are valid if:

  1. signed with electronic signatures (such as digital signature);
  2. the sender is identified through SPID, electronic identity card (CIE) or national service card (CNS);
  3. sent through the IO app;
  4. sent together with a copy of the sender’s identity document;
  5. sent from the sender’s PEC address, as well as resulting from public registers (such as INI-PEC).

And to receive communications from a public entity? Anyone has the right to elect a digital home and therefore to receive communications and notifications from all public administrations at the chosen electronic address (PEC or email).

In particular, in the event that a user has a digital domicile registered in a public register (as happens for professionals and companies) or has indicated it in the documents of the single administrative procedure (for example, in the application), the administrations and public service managers are required to use that address for all future communications and notifications.

At the moment, electing a digital domicile is an obligation for professionals and companies but – until the adoption of a specific decree – is optional for individuals and associations. When fully operational, natural persons will be able to request that their PEC address be entered in a special register, theNational index of digital domiciles (INAD), in order to electronically receive communications from all Italian administrations.

All users who have a digital home must make a diligent use of it (renewing the contract with the supplier or checking the efficiency of the tool, e.g. ensuring that there is sufficient space available for delivery); Furthermore, users must promptly notify any modification or variation of their address.

In fact, they will be able to complain about the failure to receive a communication or a notification only by proving that it is an event that does not depend on them (for example, because it is due to a malfunction of the PEC system).

Against which subjects can the right be exercised?

  • public administrations (e.g. municipalities, provinces, regions, ministries, local health authorities, schools, universities, professional associations, port system authorities, independent administrative authorities)
  • public service operators (e.g. companies that manage local public transport, postal service provider)
  • publicly controlled companies (e.g. municipal companies)

What can be done thanks to the right to online applications and digital domicile?

  • send statements and requests (for example, to start the renovation of a property or to participate in a public competition)
  • receive communications and notifications from public offices
