In a decision that has shaken the national political landscape, the Constitutional Court has overturned the creation of the Ministry of Equality and Equity.

Although in January of this year the law had been passed for the creation of this ministry of which the vice president, Francia Márquez was in charge, the process to continue with the development of this public entity was still underway until this Wednesday, May 8, The high court declared Law 2281 of 2023 unenforceable because it considered that there were procedural defects in its structuring, as an exhaustive analysis of its fiscal impact was not carried out.

“The Congress of the Republic incurred an insurmountable procedural defect: did not carry out the fiscal impact analysis of the creation of the Ministry of Equality and Equity, in accordance with the requirements provided for in article 7 of Law 819 of 2003,” explained the Constitutional Court.

The creation of Ministry of Equality and Equity had been proposed as part of a series of government initiatives to address social inequalities and promote gender equality in the country. However, the opposition considered that this measure exceeded the government’s powers and violated constitutional principles, which is why it was a recurring issue among opposition congressmen.

Thus, after several months of analysis and deliberation, the Constitutional Court finally issued its ruling, In its arguments, the court noted that the creation of a new ministry must be supported by a solid fiscal base.

It should be noted that despite this court decision, the ministry will not disappear immediately, since in fact, the Plenary Chamber resolved that the effects of this decision be deferred to two terms of office counting from July 20, 2024, which means that When the 2025-2026 legislature ends, this law will cease to exist.
