The Valledupar Circuit Court held the preparatory hearing against the Arhuaco indigenous Tobías Pérez Izquierdo, charged by the Caivas Sectional Prosecutor’s Office 13 for the crime violent carnal access with a minor under 14 years of ageafter allegedly abusing a 6-year-old child on July 10, 2023. The events were recorded on the Campo Alegre farm, located in the Palmarito village, rural area of Pueblo Bello, Cesar.
The case was reported to the authorities by the minor’s father, after his son told him what happened. when the alleged aggressor invited him to accompany him to look for a mule that had gone missing.
In the middle of the audience, Prosecutor’s Office 48 sought to demonstrate the facts with evidentiary material (testimony of doctors, psychologist, clinical history, forensic medicine report, and others) ratifying what was raised from the imputation and formulation hearing.
However, the defendant’s defense presented the interview of witnesses, one of them announcing that at the time of the events the defendant “was found asleep lying on a terrace of a resident named Nancy. She had the mule tied to a light post and her cell phone was on the ground. “They woke him up and told him to put his cell phone away and he immediately got up and left,” they expressed in the middle of the hearing, implying that at the time the events occurred, Tobías Pérez was in another place. “The conduct for which he is accused never existed”, he noted.
When the evidence was presented, the judge determined that no evidentiary stipulations were made. The hearing judge scheduled for next May 24 at 4:30 pm the beginning of the oral trial with the witnesses of the Attorney General’s Office.
